Bluth v Boyded Industries Pty Ltd - NSW Caselaw
The Court of Appeal has allowed an appeal from a decision of the Supreme Court that ordered HWL Ebsworth to compensate Boyded Industries Pty Ltd for negligently failing to provide legal advice that caused Boyded to lose the opportunity to exercise a right pursuant to a deed of call option. The primary judge held that Gateway, to which Boyded had sold three parcels of land, had an ability to pay Boyded at the time when they would have exercised the right. The Court held that the primary judge erred in that conclusion on the basis that the evidence provided by Boyded ostensibly proving Gateway’s ability to pay rose no higher than speculation or surmise.
