Republic of India granted leave to appeal interlocutory judgment to the Full Court of the Federal Court after Jackman J (Hugh Jackman’s brother) found that India had waived foreign State immunity by signing Convention on the Recognition and Enforcement of Foreign Arbitral Awards. The decision regarding foreign State immunity arises in the context of Mauritian companies seeking orders that an award of $111 million by Permanent Court of Arbitration may be enforced as if it were a judgment of the FCA (the arbitration related to the breach of an agreement for lease of satellite transmission capacity). Brett Walker SC and Justin Gleeson SC were lead counsel for the respective parties at first instance. Seems a good chance this will at least make its way to a special leave application.
