Sofronoff gets up on parliamentary privilege
Justice Abraham rules in favour of Walter Sofronoff on the issue of parliamentary privilege in his litigation with the ACT Integrity Commission, Massar Briggs Law ordered to pay indemnity costs for false citations in court documents generated using AI (see [2025] FCA 731).

“I am not satisfied that the conduct of the proceedings on the material on which the applicant seeks to rely involves an infringement of Section 16 of the Parliamentary Privilege Act,” Justice Abraham told the court.
“I’ll provide reasons for that in my final judgment.”

[91] On 3 February 2025 Ms Ponzio in an email addressed to “Associates and Judges” (see [58] above) Ms Ponzio suggested that she had previously raised the matter of Magna Carta with the Court and then asked whether the addressees were “aware that there is such a thing as THE MAGNA CARTA?”, before suggesting that “[i]f not google it”. The Court notes that Ms Ponzio had not previously raised Magna Carta as an issue.
